Jiah Khan suicide case: CBI special court rejects Rabiya's application for more inquiry against Sooraj Pancholi

Sooraj Pancholi was arrested in 2013 for allegedly driving 25- year old actress to commit suicide.

The special Central Bureau of Investigation (CBI) court has rejected the applications filed by the deceased actor Jiah Khan's mother. Rabiya Khan, where she had pleaded for more inquiry against the accused actor Sooraj Pancholi, before framing of charges against him in connection with his alleged involvement in the murder cum suicide case of Jiah. The court also rejected her application for seeking the call data records of Aditya Pancholi, the father of the deceased and two more people. However while accepting her plea of calling for the Black Berry Messenger (BBM) messages which were allegedly exchanged between Jiah and Sooraj, the court held that they would be called, as and when required during the trial of the case.

Sooraj was arrested on June 10, 2013 for allegedly driving 25- year old actress to commit suicide. A letter, purportedly written by Khan was discovered days after her death blamed Sooraj of harassment. Khan committed suicide on June 3, 2013 by hanging herself from a ceiling fan inside her bedroom.  

The applications filed by Rabiya were opposed by the prosecution as well as the defence advocate for Sooraj. The prosecution was of the view that whatever the complainant had to address the court, they had to come through the prosecution. While the defence advocate held that crucial time of the actor's life as was wasted and thus had requested the court to initiate with the framing of charges against the accused. The prosecution also claimed that the investigation in the case is thoroughly completed and has earlier been dealt by the police and later by the CBI, thus no more investigation is essential at this stage.

The court after going through the evidence placed on record, held, "There is force in the submission of defence as the matter is pending for the last four years, as no charge has been framed against the accused of the continuous petitions filed in the case. The requirement of BBM messages can be thought as and when required at the time of trial, but other plea's stands cancelled."
