Senior Congress leader DK Shivakumar approached the high court on Monday, seeking anticipatory bail regarding the case in which he is accused of manipulating facts to get a piece of land denotified.
Businessman TJ Abraham has filed the complaint, alleging that through manipulation, Shivakumar got four acres and 20 guntas at Beniganahalli, near Indiranagar, denotified when BS Yeddyurappa was the chief minister. The HC admitted the Congress leader’s petition and issued notices to the Lokayukta police in this regard. The arguments for and against granting bail will be made on Wednesday.
Abraham had filed a complaint with the Lokayukta special court, alleging that Shivakumar had approached the then CM, Yeddyurappa, with a denotification request in the name of one Srinivasan, who was already dead. As the CM was not aware of all these facts, he denotified the land. He contended that Shivakumar impersonated a dead man to get land denotified. His complaint states that Yeddyurappa is the main witness.
In his plea, Shivakumar has contended that there is no chance that he will abscond during the trial and hence he is entitled to get anticipatory bail. He has given an undertaking that he would be present during the course of the trial. Further, he has contended that the complaint has been filed only to tarnish his image.
HC rejects Sampangi’s plea
The high court on Monday rejected BJP MLA Y Sampangi’s plea seeking the suspension of his conviction by Lokayukta special court. Sampangi had become the first legislator of the state to be convicted on corruption charges.
Sampangi was sentenced to three-and-a-half years of rigorous imprisonment and fined Rs90,000. He had then challenged the Lokayukta court’s decision in the HC and got a conditional bail.
The HC did not consider Sampangi’s plea as the Supreme Court in one of the cases had observed that the lower court’s order cannot be suspended by the high court. However, since the main appeal challenged in the high court is still pending, Sampangi will not be arrested. His fate will be decided in the final hearing.
HC notice to state over MLA’s bail plea
The high court on Monday issued notices to the state government over the anticipatory bail petition filed by BJP leader and Chikmagalur MLA CT Ravi, along with his wife and two others. Ravi had sought the anticipatory bail in connection with a private complaint registered in the Lokayukta special court by Deviprasad, who accused him and others of illegally securing allotment of civic amenity sites and residential sites. Besides Ravi and his wife, his sister and brother-in-law were the other two cited as the accused. Recently, the Lokayukta court had issued summons to him to appear before the court on July 2.
‘Cong MP’s kin encroached 86 acres under reserve forests’
The assistant conservator of forests (ACF), Bellary sub-division, G Venkatesh, on Monday filed an affidavit before the high court stating that Ashok Lad, brother of Anil Lad, Congress MP and a mining baron, had encroached at least 86 acres that come under reserve forests.
KN Somashekar, an RTI activist, had filed a petition in the court alleging that the MP and his brother had encroached 20-odd acres of reserve forest land abutting their 3.65 acres land.
