In her petition, Bai alleged that Gowda—just like his predecessor, BS Yeddyurappa—had violated the law by constructing a building without getting the mandatory approvals. She questioned the legality and the constitutional validity of a site measuring 50x80ft in HSR Layout on which Gowda has constructed a five-storey building. Bai said that Gowda didn't have the BDA sanction for the building.

She alleged that the building did not have necessary approvals from any of the authorities, and, more importantly, it did not have the approval of the commissioner of the Bangalore Development Authority. Bai said she had sought the information under the Right to Information (RTI) Act when she came to know about the illegal construction.
