Iraqi student dies after bike mishap

The high court on Monday pulled up Anekal tahsildar and asked the state government to take action against him and submit a report on the land grant case by October 5.

A bench headed by justice Ram Mohan Reddy was hearing a petition filed by one Allalappa alleging that his property was being encroached upon by the gram panchayat.

He contended that on August 2, 1984 the state government through an issue of suguvali chit (grant certificate) had provided one acre of land in survey numbers 224 of Attibele village in Anekal Taluk. On January 19, 1985 Allalappa had paid a sum of `75 for the grant certificate and `60 for the survey work.

In September, 2010 the petitioner noticed that the gram panchayat was attempting to encroach his property and try to fix stones. They claimed that the land has been granted under the Ashraya scheme.

On the March 17, 2011 he came to know that records were being manipulated to show that the although the grant of the petitioner is for one acre (equal to 40 guntas and one gunta is 33 feet by 33 feet) he was actually in possession of a lesser area. Allalappa contended that such a record was being created only to justify the grant of land to the panchayat under the Ashraya scheme.

Justice Reddy observed that the tashildar has no knowledge of the Land Revenue Act and is misfit to hold the post. The court  observed the state government to shift the tashildar out of the post. “I am compelled to make this statement because it is not for the tashildar to decide as to who are the persons in occupation of the land, but his duty is to ensure a survey in accordance with the rules in respect of one acre of the land that was granted to the petitioner which is not in dispute,” he said.    inbox@dnaindia.net
