Hospital says malnutrition, not ‘hot’-water bath given by hospital nurses, killed the one-month-old baby,
Hearing a case regarding the death of a one-month-old baby in an Udupi hospital in October 2010, the high court has issued notices to Karnataka Medical Council (KMC) and stayed the order that held the nurses responsible for the death.
The baby, Mohammad Rafi, breathed his last at Kasturba Hospital in Madhav Nagar, Manipal, Udupi district, on October 9, 2010. The parents of the baby had alleged that he died because of the hospital’s negligence. The KMC had on August 2, 2012, passed an order after conducting an inquiry into the allegations. The inquiry acquitted the doctors, but held the nurses responsible for the death. The hospital challenged this order in the court.
On October 5, 2010, two staff nurses gave a bath to the baby. Allegedly, the baby received burn injuries because of the hot water bath and was treated for burns in the hospital. Four days after the bath, he passed away.
The baby’s parents accused the nurses of being negligent. Two weeks after the baby’s death, his mother sent a notice to the hospital, claiming Rs10 lakh as damages.
The hospital contended that the baby died because of lack of potassium and chlorine in blood. The hospital said the cause for the extreme degree of malnutrition was the severity of a kidney disease that is hereditary to the family.
Further, the hospital authorities claimed that the baby’s mother was trying to blackmail them.
No CBI probe into advocate’s murder
The high court on Thursday refused to order a CBI probe into the murder of advocate Naushad Kashimji, who was killed by unidentified assailants on April 9, 2009.
The late advocate’s wife, Nusrath Jahan, had knocked the high court’s doors, seeking CBI inquiry into the murder. She contended that she was running from pillar to post and striving to get the murderers nabbed, but to no avail. She approached the high court, requesting that the CBI be asked to look into the murder of her husband. The high court refused to give the charge of the case to the investigating agency.
RBI says it has no role in lending rate
The Reserve Bank of India on Thursday informed the high court that the central agency does not fix the maximum lending rate for finance companies.
The court was hearing a public-interest petition filed by one DM Suresh Babu, who alleged that two finance companies—Manappuram Finance and Muthoot Finance—have been charging exorbitant interest on gold loans. He said the two firms have been charging interest at the rate of 12%-30% while nationalised banks charge interest at the rate of 7.5%-14.75% interest on gold loans.
The RBI’s counsel informed the division bench headed by Chief Justice Vikramajit Sen that the RBI does not fix the maximum lending rate. The rate is decided by the market forces.
K’taka, AP govts told to treat water supply as urgent
The HC on Thursday asked governments of Karnataka and Andhra Pradesh to hold their proposed ministerial meeting in two weeks regarding supply of water to Pavagada taluk in Tumkur district.
In their public interest petition, Karnataka Rashtriya Kisan Sangha and other organisations from Pavagada taluk have sought a directive to the Karnataka government for supply of drinking water to Pavagada taluk through the pipeline that supplies water to Neelakantapuram Srirami Reddy water project in AP from Tungabhdra reservoir. Ten kilometres of the pipeline goes through Pavagada.
The division bench adjourned the hearing by four weeks to wait for the result of the meeting, while asking both the states to treat the matter urgently.
Petition on netas’ foreign trip adjourned
The HC has adjourned the public-interest petition questioning the foreign trip of legislators even though the state is reeling under the impact of drought.
The division bench adjourned the case when the petitioner said he would produce some additional documents to prove that the timing of the foreign trips is inappropriate.
