The high court has adjourned to Tuesday the hearing of the case wherein Swami Nithyananda has requested that the FIR filed against him in a recent case of violence in his ashram be quashed.

When the case came up for hearing on Friday, the state government filed an objection, saying that the FIR should not be quashed as there was a prima facie case against Nithyananda. The government argued that it was the instigation and provocation on the part of the swami that led to the incident, which then led to filing of complaints and counter-complaints.

The government said Nithyananda had committed a cognisable offence and the police were duty-bound to register a case and look into the allegations. It was too early to conclude if the petitioner was innocent as the investigation was in its initial stage. The government said the investigating officer was on the verge of collecting evidence.

A reporter of a news channel, Ajit Hanamakkanavar, had filed the complaint against Nithyananda regarding the incident wherein his disciples exchanged blows with presspersons. Nithyananda had filed a petition, seeking that the case be quashed. He contended that it was the reporter who was responsible for the commotion; he had brought unsocial elements with him and they roughed up the ashramites when the trouble began.

Gets bail
Nithyananda was released from judicial custody on Friday after the deputy commissioner (DC) of Ramanagaram district granted him conditional bail.

The godman was released from the prison and headed towards Madurai to avoid any trouble. The DC has put a condition that he should not hold public meetings or issue statements, as it may create disturbances.

Nithyananda was asked to provide Rs1 lakh personal surety and an undertaking that he would not create any law and order problem. Ramanagaram SP Anupam Agarwal said Nithyananda was free to go wherever he wished but would be detained again if he violated the conditions of the bail. He had surrendered before the Ramanagaram district court on Wednesday and was taken into police custody. The next day, he was granted bail but was taken into judicial custody.
