With 11,431 complaints, Ahmedabad leads in labour law violation cases

However, number of complaints that were found to be true is higher in Surat

Three major cities of Gujarat recorded the highest number of complaints and cases of violation of labour laws in the state. According to data presented in the Assembly, 59,034 complaints of labour law violation were lodged from across the state till March, of which Ahmedabad, Vadodara, and Surat accounted for 24,754 complaints.

Of the total complaints, 1,958 were found to be true. The highest number of complaints were recorded from Ahmedabad which saw 11,431 complaints of which 349 were found to be true. In all, 1,215 cases were registered in such instances.

Surat, that is home to several migrant labourers, was the second in line. The diamond city recorded 7,671 complaints of labour law violations of which only 505 instances were found to be true. In all 1,147 cases were registered in such cases.

An argument ensued between the Congress and BJP legislators with the former questioning how the number of cases were higher than the instances of such violations. The BJP minister of labour and employment, Dilip Thakore clarified that in many instances, the units were found to be violating more than one laws. Hence, the number of cases registered against them was higher than the number of units.

Vipul Pandya of Baandhkam Majoor Sangathan said that the over 11,000 complaints in Ahmedabad alone show that more and more complaints are being recorded. "But of these, if only 349 cases are found to be guilty of violations this means the department is getting more and more cases where it is involved in mediation," said Pandya.

He said when it comes to cases such as lack of maintaining a register and failure to get a license the department has to file a complaint. "But when a case pertains to lack of payment of wages, the department usually mediate to ensure that the wages are paid. In such cases, the complaints would not be registered as a case. This could explain why despite the number of complaints, the actual cases being registered is low," said Pandya.

He also added that one also needs to analyse where are most of the cases registered industry-wise. "I believe most of the violation happens in the construction sector but an analysis of the cases will throw a light on the industry that is more prone to violations," said Pandya.
