Four police officers accused in the Tulsi Prajapati fake encounter case have filed a petition before the Gujarat high court challenging the jurisdiction of the Danta magisterial court to take action in the case.
The four officers are former DGP PC Pande, additional director general of police (ADGP) Geetha Johri, suspended IPS officer Rajkumar Pandiyan and deputy superintendent of police (DySP) RK Patel. Their case has been listed for hearing before court of justice RH Shukla on Monday.
The plea is in connection with Danta magistrate Geeta Ahir’s order turning down the accused cops’ plea objecting filing of charge sheet before her by the CBI. The court also refused to grant stay over her order issued on September 18.
The CBI investigated the case and on order of the Supreme Court filed charge sheet before the Danta court, early this week. However, lawyers of the accused cop have objected the CBI’s action on the ground that, the court has no jurisdiction to accept the charge sheet and take cognizance over it.
