A day after a court in Ahmedabad issued summons to Congress president Rahul Gandhi for his comments defaming BJP chief Amit Shah, a court in Surat on Thursday issued summons to him in response to a criminal defamation suit filed by a BJP MLA for his "how come all thieves have Modi as common surname" remark.

Surat's chief judicial magistrate BH Kapadia has directed him to appear before the court on June 7.

Purnesh Modi, the BJP MLA from Surat West seat filed the complaint against Rahul Gandhi on April 16, under Indian Penal Code (IPC) sections 499 and 500 that deal with defamation.

In the complaint, the BJP legislator had accused the Congress president of defaming the entire Modi community by saying all "Modis are thieves".

He was referring to an election rally at Kolar in Karnataka on April 13, where Rahul Gandhi had said, "Nirav Modi, Lalit Modi, Narendra Modi...how come they all have Modi as common surname. How come all thieves have Modi as the common surname?"

Purnesh Modi claimed that the Congress president's remark had defamed the entire Modi community.

"There are a large number of people with the Modi surname. Does it mean all members of Modi community are thieves? He has defamed the community and also me as I have the same surname. This is why we have moved a complaint against him," he said after filing the defamation suit.

The latest summon comes a day after a city court issued summons to Rahul Gandhi in response to a criminal defamation suit filed by a BJP worker for calling BJP president Amit Shah a "murder accused".
