Gujarat: New traffic fines to kick in from Monday

Gujarat is all set to implement the amended traffic rules and fines under the Motor Vehicles Act 2019 from September 16 onwards. The state has, however, decided to give some relaxation in the fines imposed in offenders: the base rate for penalties will be lower than what has been proposed in the Act by the Centre.

Chief Minister Vijay Rupani said that the new rules would be implemented in the state from Monday.

Rupani clarified that the revised fines were not aimed at harassing citizens but to ensure their safety.

The amendment came into effect from September 1, but the state was yet to issue a notification.

It had received several representations from concerned citizens who believed that the fines were exorbitantly high.



The government has clarified that in cases where the necessary documents (e.g., licence) are not immediately available with an offender, a person can submit them within a fortnight of being charged for such an offence.

"Documents related to the vehicles including driving licence will be acceptable in digital forms," said Rupani.

Earlier the government had held a meeting with the officials concerned over the fines; before arriving at the current rates, a comparison of the existing and new penalties was made.

"The state has tried to strike a balance between the old and new fines so as to ensure that there is no financial burden on the citizen, but at the same time they are encouraged to follow traffic rules," said Rupani.

As per the new notifications, driving without a licence will earn a fine of Rs 500 for the first offence and Rs 1,000 for the second offence. It should be noted that at present the fine for the same is Rs100 while under the Centre's Act, the fine is Rs500 for first offence while it is Rs1500 for the second offence.

The government has decided to continue to fine offenders the maximum fine in cases of driving under the influence of intoxicants, rash driving and other such offences which put the lives of others at risk.

As per the new rules, driving on the wrong side or rash driving will earn a fine of Rs 1,500 to Rs 3,000, depending on the type of vehicle and the number of times the offence has been committed. It is still lower than the Rs 5,000-10,000 proposed by the Centre.
