Gujarat High Court questions multiple pleas against Rajya Sabha poll victory

According to Mangukiya, candidates can file an election petition against the returned candidates pitted against them and cannot challenge the election of other winner candidates

The arguments on maintainability of the two separate petitions filed by Congress leader Gaurav Pandya, who unsuccessfully contested the Rajya Sabha election against external affairs minister S Jaishankar, against the poll victory of Jaishankar and Jugalji Thakor continued on Monday before the Gujarat High Court.

While the single-judge bench expressed its doubts on the two separate petitions filed by Pandya challenging the same election, counsel for the Congress leader, BM Mangukiya, tried to justify the multiple petitions.

Notably, Mangukiya had earlier informed the court that five other petitions challenging the same election has been already filed and are pending before the Acting Chief Justice AS Dave on the administrative side for his instructions on which bench would hear the cases. Two of these petitions have been filed by Congress candidate Chandrika Chudasama, who lost the Rajya Sabha election against Jugalji Thakor. The remaining three petitions have been filed by Congress' leader of opposition in the state Assembly Paresh Dhanani. Meanwhile, the court has adjourned the hearing of the matter till Tuesday, when it will be taken up for further hearing.

According to Mangukiya, candidates can file an election petition against the returned candidates pitted against them and cannot challenge the election of other winner candidates. If Pandya files one election petition challenging the victory of one, the defense can raise objection claiming that although the entire election has been challenged, the other returned candidate is not present before the court.
