Gujarat High Court disposes plea for 'fair probe' in Satellite gang rape case

The Gujarat High Court on Monday disposed a petition filed by the father of the victim in the infamous Satellite gang rape case seeking a 'fair probe' in the matter. The single judge bench of Justice RP Dholaria disposed the matter after the investigation officer in the case, Panna Momaya, submitted a 'B summary report' clarifying that the girl was lying and it was a fabricated case.

Although the father had several objections to the way the probe had been carried out in the case, the bench said that the petitioner should raise those contentions before the lower court which is occupied with the matter. Notably, the high court had earlier directed the Ahmedabad police commissioner to file a report on the status of the probe in the case, the evidences collected so far, and the inferences which could be drawn from those evidences.

Interestingly, during the pendency of the matter in the high court when the police was supposed to provide details of the investigation, the investigation officer submitted a closure report before the lower court completely turning the table on the victim. In the closure report, it had been claimed that that the victim had fabricated the whole story and there was no evidence to corroborate the sequence of events as told by her. The police had also given a clean chit to the accused Rushabh Maru, Gaurav Dalmia, and Yamini Nair.

Case details

The victim in her complaint had claimed that four unidentified persons wearing masks had abducted her from Nehrunagar area in March in a sports utility vehicle (SUV). Two of them raped her and filmed the act. She alleged that she was again abducted in the same SUV by three of the four accused on the night of June 27 from Maninagar and molested before being released. One of them told her that she was raped at the instance of her boyfriend. An FIR came to be filed in Satellite police station on June 28 and police had booked seven persons, including two women and her boyfriend, for abduction and rape.
