Gujarat High Court asks state to furnish details on steps taken to protect migrant workers

The Gujarat High Court on Thursday directed the state government to provide details of the steps taken by it to dissipate the fear among migrant workers in the state with respect to the recent attacks on them. The division bench of chief justice R Subhash Reddy and justice VM Pancholi ordered additional advocate general Prakash Jani to file an affidavit in this regard by October 17.

The directions came in response to a public interest litigation (PIL) filed by advocate KR Koshti claiming that the state has completely failed to protect the rights of the migrant workers, who have played a crucial role in the development of Gujarat. Koshti has challenged the inaction of the state government to take preventive measures to contain the attacks against the migrant population. Notably, in the wake of the recent attacks on migrant workers, thousands of people from Bihar, Uttar Pradesh, Madhya Pradesh, etc, have fled from Gujarat, affecting the industries in which they were working.

Interestingly, during the hearing of the PIL held on Thursday, the additional advocate general appeared for the state government and claimed that all required steps to protect the life and liberty of the migrant population have been taken by the authorities. He said that people from all walks of life and from different region have a right to work in Gujarat and the state government is determined to protect their fundamental rights. Following the submissions, the division bench ordered him to inform the court about whatever the government had to say on the issue through an affidavit.

Notably, the petitioner has appealed to the court to direct the state government to provide appropriate security to the migrant workers. The court has been also requested to direct the state government to carry out a survey to ascertain the loss of the migrant workers and compensate them for the damages incurred by them.
