Gujarat High Court asks registry to remain cautious while dealing with sensitive files

The Gujarat High Court on Friday directed the court's registry to remain extra cautious while dealing with files and documents related to sensitive cases. The remarks came in response to the incident of missing documents from the case file in the election petition filed by BJP's Balvantsinh Rajput against the Rajya Sabha poll victory of Congress leader Ahmed Patel.

The court which was miffed with the incident had on February 1 ordered the high court's registrar general HD Suthar to carry out a probe in the matter and identify the persons responsible for the missing documents. The registrar general submitted its report to the court on Friday in a sealed envelope.

After going through the report, the court passed an order expressing its concern over the incident and to ensure that it does not get repeated. The court remarked that the system of file movement needs to be fine-tuned and people should be made accountable for the same at different levels. The single-judge bench of Justice Bela Trivedi said responsibilities of the people dealing with files should be fixed. She also issued directions to place the issue before Acting Chief Justice AS Dave for him to take any corrective measures.

In the report submitted by the registrar general, it was clarified that the missing documents were not lost, but misplaced. Notably, the election petition served upon Ahmed Patel and the summons issued to him by the court were found missing.

Meanwhile, the court on Friday went ahead with the trial in the case, with the cross-examination of Balvantsinh by the advocates of Patel. During the verification of documents, the BJP leader said he can't read English and his lawyers have explained him everything contained in the petition and affidavits in Gujarati after which he had signed them.
