Gandhinagar DEO gives clean chit to BJP in COC breach complaint

The complaint was filed against the BJP for using the chief minister's residence as premises to hold a political meeting.

The Gandhinagar District Election Officer (collector), on Tuesday, gave a clean chit to Bharatiya Janata Party (BJP) leaders in the breach of code of conduct (COC) case. The complaint was filed against the BJP for using the chief minister's residence as premises to hold a political meeting.

The report said that the chief minister's residence did not fall in the prescribed list of government buildings by the Election Commission (EC) that are prohibited from political use, especially when the code of conduct is under implementation due to polls.

The Congress party in Gujarat had filed a complaint on Sunday before the chief electoral officer (CEO) complaining against chief minister Vijay Rupani and Gujarat BJP chief Jitu Vaghani. The plaint was over the BJP's parliamentary board meeting for selection of candidates for Lok Sabha polls being held at the chief minister's residence in Gandhinagar.

The CEO Dr S Murali Krishna on Monday directed the Gandinagar DEO to investigate the matter. The DEO filed the report on Tuesday and submitted it to the CEO.

The CEO said, "The report by the Gandhinagar DEO mentioned that there was no breach of code of conduct by the BJP as the chief minister's residence is excluded from the government premises prohibited for use as per the guidelines of the Election Commission."

"The EC has debarred the use of government circuit houses, government rest houses or guest houses and daak bungalows under the prohibited category for political purpose when the code of conduct is under implementation. The report will be sent to the Election Commission for its perusal," the CEO further added.

BJP spokesperson Bharat Pandya said, "The chief minister's bungalow is his official residence and there was nothing wrong in holding the party meeting there. The Congress party also holds meetings at Sonia Gandhi's official residence in New Delhi."

Not Guilty

The report said that the CM’s residence did not fall in the EC prescribed list of govt buildings that are prohibited from political use, especially when the model code of conduct is under implementation
