Bitcoin case: Ex-MLA Nalin Kotadiya gets bail from Gujarat High Court

Kotadiya had moved the high court after his bail plea was rejected by the sessions court in February.

Former Dhari MLA Nalin Kotadiya, who is a prime accused in the controversial bitcoin extortion case, on Friday was granted conditional bail by the Gujarat High Court. Kotadiya had moved the high court after his bail plea was rejected by the sessions court in February.

The single judge bench of Justice VM Pancholi granted bail to the former MLA on the condition that he cannot enter Amreli district for the next one year. Also, the court has clarified that he will have to file an undertaking that he will not claim any bitcoin, or any amount or asset, which is recovered during the course of investigation.

In order to secure bail, Kotadiya's lawyer Zubin Bharda contended that the case against Kotadiya has been built up based on the statements of the co-accused and is based on 'conjectures and surmises'.

He argued that the lawmaker is being considered as a co-conspirator based on some circumstances and all these have to be proved before the trial court. Bharda also said that the lawmaker cannot be kept behind bars based on the statements 'prepared by the police. While the state government opposed bail plea of Kotadiya, the court ruled in favour of the former lawmaker.
