Ahmedabad Municipal Corporation (AMC) has decided to frame a policy to issue development permission (DP). The decision comes following the Gujarat High Court’s ruling to cancel DP issued by the Ahmedabad Urban Development Authority (Auda) to Dharmadev Infrastructure for construction of Neelkanth Villa Bungalow at Bopal.
Dharmadev Infrastructure, meanwhile, has decided to move the Supreme Court as the HC quashed its review petition against the judgment passed by the division bench on Friday. Following a dispute over the final plot allotment in the Draft Town Planning Scheme (DTPS) No. 1 of Bopal, Dharmendra Patel had filed a special civil application in the court in 2012.
In a judgment passed on March 15, 2011, Justice MR Shah quashed the DP granted by Auda to Dharmadev Infrastructure on July 1, 2009, for building the Neelkanth bungalow. The court, said that when the DTPS was not sanctioned as it was pending with the state government and when there was objection regarding some plot, the developer cannot be permitted to go ahead with the construction.
The developer’s appeal against the judgment of the single judge before the division bench, comprising Justice Vijay Sahai and Justice SG Shah, was quashed in April 2013. On Friday, the review petition was also dismissed.
Umang Thakkar, chairman and managing director of Dharmadev Infrastructure, said they would move SC. “Meanwhile, we will also try to have the draft TP scheme finalised by the state government as soon as possible,” he said. The residents are worried about their future despite the developer’s assurance to resolve the problem.
The civic body, meanwhile, has decided to review its policy over issuing DP. At present, there are nearly 90 DTPS in the city which have been submitted to the government for approval.
“We will take a legal opinion and formulate policy to grant development permission in areas under draft TP schemes,” said Bhupendra Patel, chairman of AMC’s standing committee.
