Show cause to BCCI office-bearers; COA told to draft constitution

On a day when Supreme Court issued a show cause notice to BCCI office-bearers — acting president CK Khanna, acting secretary Amitabh Choudhary and acting treasurer Anirudh Chaudhry — apart from issuing contempt notice to Amitabh for not implementing the Justice Lodha reforms, the Committee of Administrators (COA) has been given the task to prepare the draft constitution keeping in mind the July 24 orders.

This has come after amicus curiae, Gopal Subramaniam, told the three-judge bench comprising Justices Dipak Misra, AM Khanwilkar and DY Chandrachud that BCCI hasn’t implemented even a single recommendation despite their orders on July 24 that specifically pertained to implementation of the reforms.

The Apex court was so upset with BCCI members that it summoned the acting secretary for personal appearance on September 19, next date of hearing, to explain “why contempt can’t be initiated against him for not honouring the orders”.

This is similar to the January 2 situation when former president Anurag Thakur and secretary Ajay Shirke were removed for non-compliance of SC orders.

In any case, COA has already sought removal of all the three office-bearers in its fifth status report filed last week.

The contempt notice to Choudhary was initiated after Cricket Association of Bihar (CAB) alleged that Choudhary had withdrawn money from Jharkhand State Cricket Association (JSCA) even after demitting his post of president. CAB secretary Aditya Verma also pleaded that all his allegations were based on authentic RTI replies of public sector banks and he was ready to file it in the form of affidavit.

It was during the course of arguments made by BCCI office-bearers’ counsel that “there are five practical difficulties in implementing Justice Lodha panel report” that Justice Misra recalled a Mahabharata anecdote to drive home his observations… “It is like Yudhishtir, Arjun, Bheem, Nakul and Sahadeva are all dead and Kunti is still the mother”, obviously trying to say that Justice Lodha panel has only these five main recommendations and without these how could there be any cleansing inside the BCCI.

It was after this that the Court directed COA to draft the constitution. “The draft constitution will be circulated to BCCI and it will give its suggestions,” said bench, adding: “We are open on certain issues but BCCI hasn’t done anything.”
