The Indian cricket board on Wednesday appointed new senior selection panel along with announcing secretary Ajay Shirke's election in complete defiance to the Supreme Court-appointed Justice RM Lodha committee recommendations.

This has come even after Justice Lodha warned the Board of Control for Cricket in India (BCCI) to resist from doing anything more than the 'routine business' during the course of annual general meeting (AGM). According to sources in the panel, "there is no other way now left but to initiate contempt of court proceedings against the board".

"Any decision that has been taken against Lodha panel advice is null and void," said the source on Wednesday.

dna has also learnt that the Lodha panel is closely reading the BCCI's response, sent after the AGM, before taking a final call.

"We need to take a closer look at all the decisions, which were taken in the AGM before deciding the course of action," added the source.

However, BCCI secretary Shirke said, "BCCI has to function on a day-to-day basis. There is the 500th Test match starting tomorrow. Do we say that the BCCI will function without a secretary?

"The secretary is the principal (executive) officer whose election had come to an end and going forward — whether it is to take instructions from the court or take decisions arising out of court — the secretary is the empowered person. So this is merely carrying out our day to day affairs; and all our decisions are subject to any orders of the court," he reasoned out.

"It might be that tomorrow the court says all this is bad or illegal, we will have to go by that," added Shirke.

Incidentally, BCCI was asked to resist from naming the new selection panel. The richest board under the presidentship of Anurag Thakur did not just violate the Lodha panel diktat by naming the selectors, but also the spirit of the Apex court appointed panel's recommendations to "reduce the strength of selection panel from five to three" in order to bring an end to regional quota system in selection panel.

Former wicketkeeper-batsman MSK Prasad (South) will lead a panel of five selectors consisting of Sarandeep Singh (North), Devang Gandhi (East), Gagan Khoda (Central) and Jatin Paranjpe (West), again against the recommendations of having Test cricket experience must for all.

Former India seamer Venkatesh Prasad has been retained as chairman of the junior selection committee.

Contempt by whom?

Some of the BCCI members also called for lodging a protest with Justice Lodha regarding panel's secretary Gopal Shankarnarayan's alleged remarks regarding selectors.

However, no conclusion was reached regarding this. dna has learnt that it was Brijesh Patel and MP Pandove who demanded taking legal steps against Shankaranarayan.

On the other hand, the sources are of the view that it is Shirke who invited defamation after circulating a letter which contained "comments that were never made".
