India needs to focus on filing of patents

Although patent filing is much easier in India as compared to other countries, only 40,000 patents are filed in India annually.

Although patent filing is much easier in India as compared to other countries, only 40,000 patents are filed in India annually. The procedure takes less than two years in India, while in other countries like China, where more than 4 lakh patents are filed every year, it takes at least four years.

Interestingly, indigenous patent filing is not even 30% in India, while in other countries it is more than 50%.

“India is emerging as an economic power which means more and more research and innovations are taking place in our country. So patent filing is very important. The carelessness shown by our companies can be estimated by the number of foreign companies that are filing for patents in India is more than our own companies,” said Rajesh Acharya, managing director, HK Acharya & Company and also managing trustee of MarkPantent during a conference on Intellectual Property Rights (IPR).  A two-day conference was organised on ‘Accelerating growth of IPRs in global Village.

“The number of applications for trademark is increasing in our country these days, but no active step has been taken in patent filing. Gujarat is the pharmaceutical hub of India. Only a few drugs have been patented, while foreign companies are very conscious in this matter. In fact, they file for patent in each country where they start their operations,” he added.

Gert Wiirtenberger, an attorney from Germany, said, “World economy is driven by intellectual capital. The strength of business in a country can be determined by the strength of IPRs, which is very less in India. There is a need for a strategy that encourages more and more companies to file for IPR”.

“Gujarat is among the top three states for filing IPRs in India. But since Gujarat makes a substantial contributing to the country’s total GDP, more initiative should be taken by Gujarat-based companies. Mechanical, pharmaceuticals and biotechnology are the fields where most patents from Gujarat are filed,” said Acharya.
