12-year-old's testimony seals fate of killer woman, paramour

A woman and her paramour who brutally killed her husband were on Saturday, sentenced to rigorous life imprisonment by a Delhi court which relied on the eyewitness account of her 12-year-old son.

The unequivocal testimony of the child that it was his mother and uncle who killed his father virtually sealed the fate of accused who wanted to get rid of the victim as he had come to know of their illicit relationship.

Additional sessions judge Chandrashekhar also imposed a fine of Rs 35,000 each on Shama Parveen and her lover Tohid Raza after holding them guilty of murder under Section 302 and of criminal conspiracy under Section 120B of the IPC.

The court also sentenced Khalil, an auto-rickshaw driver, who helped them in disposing off the body to seven years' rigorous imprisonment along with a fine of Rs 10,000 after holding him guilty of destruction of evidence under Section 201 of the IPC.

According to the prosecution, Parveen, who was having an affair with Raza, hatched the conspiracy with him to eliminate her husband who had got a whiff of their illicit relationship.

They attacked the victim with rod on February 14, 2002 after their attempt to smother him with pillow did not succeed, it said, adding that they also attacked him with a sword.

In a bid to show the victim's death as an accident, the two, along with the driver, dumped his body with a two-wheeler in a drain at Dilshad Garden.

After the post-mortem revealed pre-death injuries to the victim, the police interrogated the woman who confessed to the crime. The prosecution examined 24 witnesses including the woman's son to prove their charges in the case.
