NEW DELHI: The supreme court (SC) lamented on Tuesday that the nation’s justice delivery system was “rotting” as it rejected soft drink giant Coca-Cola’s plea challenging the criminal proceedings initiated against it by the Rajasthan government in an alleged case of adulteration.

The judges’ disgust with the dispensation system surfaced when it was told that the case was registered six years ago but did not come up for hearing even once.

Justices BN Aggrawal and GS Singhvi observed, “It indicates that the entire criminal justice system is rotting.” The judges also asked Coca-Cola lawyer UU Lalit why the company did not move court for relief and instead waited for six years to file a petition in the Rajasthan high court.

“How come the case has not come up for hearing for five-six years?” the bench said and dismissed Coca-Cola’s petition challenging the high court order.

On September 26, 2000, the food inspector at Sikar in Rajasthan filed a criminal case against the company and its officials alleging the chemical analysis of a certain sample was found to be adulterated.

The case did not come up for hearing until October 17, 2006, when a bailable warrant was issued against the officials. Coca-Cola contested the allegation saying the complaint was false as the public analyst’s report contradicted it. The public analyst’s report at one place terms the samples carbonated water and at another place “synthetic fruit beverage”, the company said.

The high court had earlier vacated the interim stay it had initially granted on the criminal proceedings pending before the additional chief metropolitan magistrate, after which Coca-Cola moved the apex court.
