She accuses him of rape, he alleges she has stolen his confidential papers

The Powai police on Tuesday arrested a woman following a complaint of theft filed by her husband. The husband, on the other hand, will be arrested on Friday as per a court order following the wife’s complaint of rape against him. 

According to the police, Bharti Kadam, 34, and Pandurang Doke, 39, were living together since June 2005. Kadam claimed that she married Doke at a temple in Ghatkopar in the presence of her relatives. However, the marriage was not registered.
Their relationship soured when they realised that both of them have not divorced their previous spouses. Doke had, in fact, married twice before. The couple, who are residents of Powai, then registered cases against each other.

Kadam alleged that Doke had raped her since he had a physical relationship with her after making false promises of marrying her. Doke had not shown any interest in getting their marriage registered and, hence, in the eyes of the law she would not be considered his wife, she said.

Doke, on the other hand, accused Kadam of stealing confidential documents belonging to the Brihanmumbai Municipal Corporation (BMC) from their Powai residence. He is an inspector with the licensing department (shops and establishment) of the BMC in Goregaon.

Kadam has been charged under Section 380 (theft in dwelling house), while Doke is booked under Section 376 (rape) of the Indian Penal Code. A notice has been sent to Doke intimating him that he would be arrested.

Kadam, a teacher in a private school, in her police complaint stated that she befriended Doke and decided to marry him. However, she realised that Doke had kept her in the dark about his two earlier marriages and he still had to get a divorce from his second wife.

According to police inspector Ashok Jadhav of the Powai police station, Kadam informed Doke about her first marriage and told him that she had applied for a divorce. “But Doke had hidden the fact that he had married twice earlier. Kadam learnt about it only when she insisted on getting their marriage registered,” said Jadhav.

Kadam got furious on knowing about his earlier marriages and filed the complaint. When Doke learnt that Kadam had filed a complaint against him, he, too, lodged a complaint against her.

“We have found both of them guilty. Kadam has stolen the documents, while Doke cheated Kadam by making false promises of marrying her,” said senior inspector Rajdoot Rupwate of Powai police station.

“Kadam claimed that she got married with Doke at a temple in Ghatkopar in the presence of her relatives. But the marriage is illegal because it was not registered,” he said.
