The controversial MIG Cricket Club, Bandra, failed in its last-minute attempt to secure permission to have a new year's eve party on the ground on Monday.

Justice DY Chandrachud, vacation judge of the Bombay high court, rejected the club's application to hold cultural events on the ground.

After failing to get the BMC's permission to hold cultural events and felicitation of sportsmen on the ground, the club had moved the high court. The application was opposed by the BMC, the Abhinav Sahakar Education Society (ASES), and residents of the area.

Advocate Kamal Bulchandani, who represented the ASES, said, "The application was put up on Friday and kept for hearing today. They were saying they have a programme on December 31 on the ground of MIG. The court said they cannot have any cultural event."

The court cited an earlier order of the Supreme Court, which upheld an interim order passed by the high court in 1997 and considers the entire plot to be a single playground where cultural events cannot be held.

But there was confusion in the evening over holding the event in the club. The BMC and the local residents interpreted the order differently from the club and police.

Preeti Purandare, assistant law officer of the BMC, said, "The order observes that this is a composite ground and since there is no demarcation, the portion covered by the clubhouse cannot be used for cultural events, except for functions mentioned in section 37(A) of the Maharashtra Regional Town Planning Act."

Section 37(A) allows the use of public grounds to celebrate only national events such as Independence Day and Republic Day.

The residents wanted the police to stop the event in the club and approached the Kherwadi police station late in the evening with the court order.

Deepak Anawkar, a local resident, said, "We have given the order to the police and are waiting outside the club, but they are not taking any action as there is music and people coming to the party in the club premises."

RN Tadvi, deputy commissioner of police (zone VIII), said, "My officer is present there. There is no party as such. Only food is being served and we cannot stop that. No cultural programme is taking place."

Pravin Barve, general secretary of the club, said, "The matter is subjudice. The order is to get clarification from a regular bench."
