Bus to be released only after absconding driver is caught: HC

NEW DELHI: The Delhi High Court has refused to release a blueline bus, seized after being involved in an accident, saying it cannot be released until the absconding bus driver was caught.
      
"First give the details of whereabouts of the absconding bus driver and conductor, only then the vehicle would be released," a vacation Bench comprising Justice Sanjeev Khanna and Justice Vipin Sanghi told the bus owner.
      
The owner, who was personally present in the Court on Wednesday, expressed his ignorance and said he was not aware of the whereabouts of the erring driver and conductor as he did not have his address.
      
Not satisfied by his contention the Bench said, it is not possible to believe that you do not know where they are.
      
"Till you give us the details of the whereabouts of the driver and conductor, we would not move forward in the case," the Bench said, adding it was necessary for the bus owners to verify the address and driving licence of a person before recruiting them as driver.
      
The blueline bus had hit a man on December 2 causing grivous injury to him who has been in hospital since then.
      
Advocate Rajdeepa Behura, appearing for Delhi Police informed the Court that FIR has been lodged against the driver and the conductor. Non-bailable warrant has also been issued against them after the police fail to trace them.
      
Opposing the release of bus Behura contended that driver also tried to threatened the eye-witness of the case.
      
The Court, after hearing the contentions, refused to grant any relief to the bus owner and directed him to cooperate with police in tracking the erring driver and conductor.
