HC issues NBW against kidnappers

MUMBAI: The Bombay High Court has issued non-bailable warrants against a youth and his relatives on a habeas corpus petition filed by a person alleging that the boy, abetted by his relatives, has kidnapped their minor daughter.
 
Division bench of Justices R M S Khandeparkar and Amjad Sayed issued NBW against Sunny Chawariya (22), his uncles Azad and Sanjeev Chawariya and mother Jagwati Chawariya on Thursday after they failed to turn up in the court despite its earlier order.
 
According to the petitioner Ramayan Sahani, a resident of Eksar Dongri in suburban Borivali, his minor daughter had accompanied her mother to a nearby temple on September 14 last year.
 
On the way it started raining heavily, the girl returned home as the duo was not carrying an umbrella, Sahani said, adding when her mother reached home, the girl was nowhere to be found.
 
The girl's parents registered a missing complaint with the Borivali police station the next day.
 
A day later, they found that Sunny too was missing from the evening of September 14, 2006.

Sahani has alleged that Sunny's relatives dissuaded them from lodging a complaint against him and asked them to marry their daughter to him.
 
The girl's parents also alleged that the police register an FIR against Sunny only after a member of the Human Rights Foundation intervened.
 
Despite various complaints to police authorities, nothing has been done to find the girl, the petition says. Their daughter is still missing and they are apprehensive that her life may be in danger.
 
The petitioner has prayed to the court to direct the police authorities to find and produce their daughter in court.
