Court seeks reply from SRK on violation of building rules

MUMBAI: Actor Shahrukh Khan will have to again face judicial scrutiny in connection with the alleged violation of regulations in a structure built by him adjacent to his bungalow here.
   
A division bench of the Bombay High Court comprising Chief Justice Swatanter Kumar and Justice Dhananjay Chandrachud on Thursday asked the actor and the Municipal Corporation of Greater Mumbai to file replies in two weeks explaining the alleged violation of the Development Control Regulations.

A PIL filed by city-based Bharashtachar Nirmulan Sanghtana (BNS) has alleged that a building constructed behind Shahrukh's bungalow has encroached on land earmarked for a road, reducing its width from 9.15 metres to about six metres. The road has been marked in the development plan, it said.
   
BNS lawyer Shakuntala Joshi on Thursday made a fresh allegation that the balcony of the new building hangs over the land for proposed road, which is illegal. She also produced photographs to back her claim.

Joshi further alleged that during earlier hearings, the MCGM and the actor had claimed that the "roadline" or width of the proposed road had not been curtailed.

Shahrukh's lawyer Darius Khambatta opposed the PIL, saying he was being dragged into the case "to give it some colour".

Khambatta said that the Supreme Court had last year dismissed another PIL against Shahrukh that had challenged the construction. "This is pure harassment," Khambatta said.
   
The court, however, sought replies to issues raised by Joshi in the PIL.

The petitioners have also raised the issue of alleged violation of development control rules by Sonam Earth Movers and Goodwill Builders while constructing a mall and a housing project in suburban Malad and Kandivali respectively.

Their lawyers on Thursday hotly disputed the clubbing of the three unconnected matters in one PIL. Joshi, however, argued that in all these cases, MCGM officers had allegedly connived with builders in the violation of the regulations and so they were clubbed.

The court, however, said each case will be heard separately.
   
Regarding the alleged violation of rules in the case of the mall in Malad, the court directed the MCGM's executive engineer to be present in court when the matter is heard next week.
