SC reserves verdict on compulsory marriage registration

NEW DELHI: The Supreme Court on Monday reserved its orders on the issue of making registration of marriages compulsory for all communities in the country.

A Bench of Justices Arijit Pasayat and P Sathasivam reserved its orders after perusing the compliance reports submitted by most of the States through amicus curiae and senior counsel Ranjit Kumar on the issue.

Kumar told the apex Court that barring a few States like Uttar Pradesh, Assam, Arunachal Pradesh and Union Territory of Chandigarh, rest of the States had complied with the earlier directions of the Court for making marriage registration a compulsory exercise.

The Bench then said it was giving three months time to the non-complying States to comply with the directions.

During the last hearing the Supreme Court had made it clear that registration of marriages should be made mandatory for all communities in the country and cannot be restricted to any one community.

The apex Court gave the direction after the amicus curiae submitted that many States were enacting legislations making it mandatory only for the Hindu community by incorporating the provisions of the Hindu Marriages Act; though the Court's direction was making it compulsory for all communities.

In February last year, the Supreme Court had directed the States to formulate suitable legislations for making marriage registration compulsory.

The directions were issued by the apex Court while dealing with a matrimonial dispute following complaints that a large number of spouses were involved in bigamous relationships as there was no proper mechanism to establish a marriage.

There have been suggestions from various quarters particularly NGOs that marriages should be registered compulsorily to put an end to the menace.
