Missing son brings mother to India

SURAT: The search for her five-year old son brought a distraught mother to India after the American intelligence agency FBI appeared to have traced the boy, who allegedly went missing three years ago, in Navsari.

Deepa Topiwala, an NRI, landed in India to regain the custody of Mihir (5) after FBI informed her that Nimesh Topiwala, her former husband, had allegedly whisked away the boy to Navsari.

"I have filed a habeas corpus in Gujarat High Court and it has ordered the police to produce the child before it", Deepa said.

Deepa got married to Nimesh in 1999 and gave birth to a boy. However, due of irreconcilable differences between the two, they parted ways after a few years of marriage, she said, adding Mihir was in her custody even after separation.

"But when his father was allowed to meet Mihir (who was then two and half years old) occasionally following a court order in 2004, during one such meeting, he whisked away our son to India without my knowledge", Deepa alleged.

The FBI information that Mihir had been brought to Navsari led Deepa to India, subsequent to which she filed a habeas corpus petition in the High Court submitting that she be given the custody of her son who was with her husband and in-laws- Harikrishna Topiwala and Hansa Topiwala.

Irritated with the slow progress in the case, Deepa is now beginning to lose her patience.

"I am time and again falling sick here as I am facing difficulty in adjusting to the atmosphere in India," she said, hoping Mihir would soon come back to her.

The matter would come up for hearing before the court on August 16.
