SC refuses to extend deadline for filing of undertakings

NEW DELHI: The Supreme Court on Thursday refused to extend the deadline for filing of undertakings by traders operating commercial units out of residential areas in the national capital.

The Apex court, however, agreed to hear the Centre's application on other sealing-related matters on February 2.

The application was heard by a bench headed by Chief Justice KG Balakrishnan.

The Ministry of Urban Development had submitted that it was seeking extension of relief granted by the court's September 29 order in view of the proposed Masterplan of Delhi, 2021, which is likely to be notified shortly.

While fixing the matter, the court questioned the plea by the Centre and the Municipal Corporation of Delhi (MCD) seeking extension of time for filing of affidavits by the traders.

"Traders only had to file the affidavits. Where is the question of extending the time," the bench observed.

The court had by its September 29 order directed the owners of such premises that they have to file an undertaking before the monitoring committee that the misuse would be stopped if ultimately the court comes to the finding that the notification and the Delhi Laws (special protection) Act are to be held invalid.
