A procedural goof-up by the Kurla police station for the Commissioner of Police, who now faces a notice from the Sewree sessions court.

The court took the step after two police officers of the Kurla police station recorded two diametrically opposite statements of a murder accused.

In its notice, the second fast track court at Sewree asked the police commissioner why action should not be taken against the two “erring” police officers.

During the hearing of a murder case, the defence brought to the notice of the court that the accused had been provided by two statements of the brother of the deceased, who is also the witness in the case. Both the statements are contradictory to each other.

In one statement, which is unsigned but brought on record, the witness says he had seen the accused murder his brother by hurling a stone at him. However, in the other statement, which is signed, the witness says that he was not present at the time of the alleged offence and was at home.

The matter took a serious turn when the court found that the original documents were not submitted in the court till Monday by the Kurla police. The court expressed shock at the working of police station.

The alleged murder happened on March 17, 2006, the day riots had broken out in Ghansoli area of Navi Mumbai when Mathadi Kamgars clashed with the local residents. Following the incident, the labourers working in Kurla went on strike. Since they did not have anything to do on that day, they had ordered for lunch and drinks. According to the police, two labourers, Hemant Kotekar and Baban Jadhav in their drunken state allegedly killed another labourer Harish Galphade.

During the hearing at the sessions court, the court was told that the investigating officer could not attend since he was not well and therefore hospitalized. The next hearing will be on January 6. The police commissioner is also expected to give his reply by then.
