Gangster Ejaz Pathan seeks bail on health grounds

MUMBAI: Gangster Ejaz Pathan, facing the charge of participating in the conspiracy hatched by Dawood Ibrahim to carry out the 1993 serial blasts, has sought bail on the ground that he is seriously ill and suffering from several diseases.

 

Pathan, who has undergone an angioplasty and suffers from backache, a clot in the brain, diabetes and high blood pressure, has filed a bail petition in the designated TADA court.

 

Pathan on Friday asked for a wheelchair to move about in the court and judge P D Kode has called for his medical reports to decide on his plea. The matter has been adjourned until the court gives an order on his bail plea.

 

Pathan, who was deported from Dubai in May 2003, had allegedly targeted several businessmen and industrialists for extortion before his arrest in connection with the 1993 blasts that killed 257 people.

 

According to his lawyer Abbas Kazmi, Pathan was earlier admitted to a jail hospital and is suffering from health problems like cataract, diabetes, colon ulcers, cerebral infraction and spinal pain.

 

Pathan was taken to J J Government Hospital but MRI and echo tests could not be done because of lack of equipment, he pointed out. Kazmi said he should be freed on bail so that he could be treated in a private hospital.

 

The CBI has opposed Pathan's bail, saying he was an absconder and was deported after a Red Corner Notice was issued against him by Interpol. It said the treatment in the government hospital was adequate.

 

Pathan is one of 123 people being tried for the 1993 blasts. The court has begun delivering verdicts against them and 11 people have been convicted so far.

 

Pathan was arrested under the now defunct Terrorist and Disruptive Activities (Prevention) Act after his deportation from Dubai and charged with participating in the bomb blast conspiracy between December 1992 and March 1993 in Dubai and India.

 

According to CBI, Pathan allegedly attended a meeting in Dubai at the residence of prime accused Dawood Ibrahim to commit terrorist acts in India to avenge the demolition of the Babri mosque at Ayodhya and the subsequent riots.

 

The CBI has charged Pathan with sending his men Manoj Kumar Banwarilal Gupta alias Munna, Ehtesham, Shahnawaz Khan, Akbar Abu Sama Khan and Karimullah, who is absconding, to smuggle arms through the Shekhadi coast in Raigad district in the first week of February 1993.

 

Pathan has also been charged with sending his men to Pakistan via Dubai for arms training in collusion with co-conspirator Mushtaq "Tiger" Memon. These men were Shaikh Mohammed Ehtesham, Haji Ghulam Rasool Shaikh, Sultan-e-Rome, Sardar Ali Gul and Shahnawaz Khan Faiz Mohammed Khan.

 

Pathan is also charged with receiving a bag containing three AK-56 rifles and nine magazines from Memon and giving these weapons to Dawood Mohammed Yusuf Khan for distribution among others.
