CBI seeks death penalty for Memon brothers

The Central Bureau of Investigation on Friday sought death penalty for Yakub, Essa and Yusuf, all brothers of absconding prime accused Tiger Memon.

MUMBAI: The Central Bureau of Investigation on Friday sought the death penalty for three brothers of absconding prime accused Tiger Memon, who were found guilty in the 1993 serial blasts case, even as they pleaded for leniency from the TADA court.
 
Making his arguments on the quantum of punishment for Tiger Memon's brothers Yakub, Essa and Yusuf, CBI lawyer CS Sharma said they had committed "a brutal crime". As this was the rarest of rare cases, capital punishment should be awarded to them, he said.
 
For Rubina, the sister-in-law of Tiger Memon and the fourth member of the Memon family found guilty by the court for the serial blasts that killed 257 people, the CBI sought life imprisonment as she is a woman.
 
The Memon brothers were responsible for the gruesome murders of the victims of the blasts and the court should consider the brutal force used in executing the chain of explosions, Sharma said.
 
Yakub's lawyer Harshad Ponda pleaded for a lenient sentence, saying he was not deeply involved in the conspiracy.
 
Ponda said Yakub had spent 12 years in prison and this should be treated as part of the sentence.
 
Ponda cited the judgement in the Nalini vs CBI case in which the accused, who were charged with being party to a conspiracy, were categorised on the basis of their roles. In this case too, Ponda argued, the accused should be categorized and Yakub should be shown leniency.
 
Essa, Ponda said, was suffering from brain tumour and had been in jail for 12 years. His jail term should be treated as undergone and he too should be let off, Ponda said.
 
Yusuf was suffering from schizophrenia and was released on bail in 1995 after spending five years in prison.
 
He too should be let off, Ponda said.
 
Ponda pointed out that Rubina had spent 32 months in prison and sought a lighter sentence for her as she small children and was not deeply involved in the conspiracy.
