‘HC observation was uncalled for as case is being probed’

NEW DELHI: The Mumbai police on Monday moved the Supreme Court for quashing the bail granted to former BCCI supremo Jagmohan Dalmiya.

Dalmiya is facing charges of misappropriating about Rs600 crore during the 1996 World Cup.

The Bombay High Court had granted him anticipatory bail and held that the present cricket body had framed Dalmiya.

BCCI’s complaint with the police said Dalmiya illegally transferred money from BCCI account to Cricket Association of Bengal account, for which there was no explanation and the BCCI management was kept in the dark about this transaction.

The police registered a case of cheating and criminal breach of trust.

On behalf of the Mumbai police, the Maharashtra government’s appeal said the observation of HC was totally uncalled for as the case was still under investigation.

It said high court overstepped its power and made some observations that are premature and are contrary to the settled law of land that courts are not supposed to interfere with the investigation except under exceptional circumstances.

It also sought quashing of HC order and said otherwise it would cause great prejudice to the state and also have adverse effect on the ongoing investigation into the case.
