Pune writes Lok Adalat history; 64,000 cases resolved in a day

Various courts see more than 1.30 lakh cases; remaining will be heard today

With over 64,000 cases been settled, Pune topped the list at the first mega national-level Lok Adalat on Saturday. More than 100 panel members were present at the various courts, including family courts, consumer forum and accident tribunal. More than 1.30 lakh cases were summoned for Lok Adalat and the remaining will be heard on Sunday.

80-yr-old decides to pay daughter-in-law to avoid court visit
More than 200 cases were on board for settlement and 120 were heard in family court. A 30-year-old woman Pinky (name changed to protect identity) from Sahakarnagar was accused in abetment to suicide case of her husband who had allegedly committed suicide in 2010. Pinky, who runs a boutique shop, had filed four cases against her in-laws under the provisions of Domestic Violence Act, Hindu Succession Act and also demanded alimony from her in-laws. Pinky’s father-in-law Ramesh (80) had approached the family court through lawyer Vikas Shinde and claimed that he wanted to settle the matter by paying Rs5 lakh to her.

Speaking to dna, Ramesh said, “I decided to settle the matter by paying her the amount as I would not have to go to court at this age. I have lost my son but my granddaughter should not suffer. I have availed of a personal loan of Rs5 lakh that I will be paying to Pinky to settle the case.”
In another case, 30-year-old woman Anne (name changed to protect identity) working in a call centre at Magarpatta City had approached the panel members before judicial magistrate (first class) Jyoti Kotnis and lawyer TD Isaac claiming that her husband who is manager at a Hinjewadi-based call centre is not paying her alimony. The couple realised that the cause of dispute was misunderstanding. After the panel spoke to the couple, they happily left the premises with a promise to not take the legal measure again.

Bajaj Allianz insurance firm pays Rs4 lakh to beneficiary
An insurance company has been asked to reimburse Rs4 lakh to a 72-year-old man under the overseas travel insurance policy after he had fallen ill on a trip to Malaysia in 2009. The matter that was pending for a year before the Pune Court was settled in the Lok Adalat held on Saturday.
The complainant, Senji Rajagopalan Srinivasan, is a retired employee and hails from Bangalore. He is residing at Magarpatta and had filed a claim against Bajaj Allianz General Insurance Company Limited in 2009 after the company refused to pay him treatment expenditure.

Srinivasan’s lawyer Ashok Pathare said, “My client had purchased the overseas travel insurance policy of Bajaj Allianz in October 2009 before going to Malaysia. Srinivasan fell ill in Malaysia and was admitted to Loh Guan Lye and Sons Hospital for treatment. Srinivasan incurred an expense of Rs4,01,971 for hospital treatment. The insurance company denied to pay the amount on overseas issues and rejected Srinivasan’s claim saying that his medical condition existed before the overseas visit. Srinivasan had moved the Bangalore court but the court threw out his claim on the point of jurisdiction in 2012. Through Lok Adalat, Srinivasan got a cheque for Rs4 lakh handed over to him by Amol Adgaonkar, zonal incharge (Central Zone) Bajaj Allianz.

Court hears 55 cases falling under Cantonment
Assistant provident fund inspector had filed 55 cases in 2000 against Cantonment-based businessmen and their firms under the provisions of Employee Provident Fund and other miscellaneous purposes. After examining the documents, the inspector found that firms were not paying PF to their employees. The irregularity attracts a fine of Rs5,000 and can exceed to Rs10,000 and imprisonment for 2 years. After discussing with both the litigants, the firms pleaded guilty and paid Rs5,000 fine in each case. The case was heard before the panel members of judicial magistrate (first class) Vinay Murglikar.

In another case, a person was framed for stealing a gas cylinder registered in the name of Jyotiram Pakare (27), an LPG gas cylinder home deliveryman. Pakare had parked his bicycle and went up to the second floor of a building to deliver a cylinder and found one of the gas cylinders stolen when he returned to the parking lot. He had nabbed Pandurang Korade (44) who had stolen the cylinder and handed him to the police. Pakare said, “I withdrew the case as Korade was suffering a lot of hardship due to lack of cylinder at his house and this is problem faced by all. He had no bad intention and approaching the court for this minor issue was not required.”
Another case was registered at Cantonment police by Parshuram Chaudhary who runs a garment shop in Camp. Two college youths had stolen his two-wheeler in 2006. On Saturday, Chaudhary approached the court after telling the two youths to be present also and suggested the panel that he wanted to withdraw the cases. He said that he does not want to spoil the boys’ career. The panel magistrate Muglikar asked Cantonment police to check the duo’s criminal past and the cases were withdrawn later by noon after the police informed that they have a clean past. The youths were warned and let off.

Four persons get Rs9.5 lakh at accident claims tribunal
An insurance company agreed to pay Rs9.5 lakh to four claimants who had applied for compensation for road accident that took place in 2009 and had moved the accident claims tribunal. According to the complaint, Datta Chafekar, Samir Chafekar and Sampada Deshpande had suffered injuries while Swati Chafekar, Datta’s wife, had died due to injuries. VG Kulkarni, who represented the claimants, said that on May 16, 2009, the four were travelling back to Pune from Mumbai airport to drop Datta Chafekar’s daughter Shraddha Phadke who was going to the US to stay with her husband when they met with the accident. The jeep they were travelling (MH 14 BA 3513) collided with a bridge parapet wall and caused the mishap. Four hearings of the case were heard at the Motor Accidents Claims Tribunal (MACT) at Shivajinagar. Royal Sundaram Alliance Insurance agreed to settle the claim by paying Rs9.5 lakh as a lump sum amount to the four claimants.
