Lawyers to abstain from work today

Lawyers across Maharashtra have decided to abstain from work on Monday to protest against the assault on lawyers in Jaipur and Chandigarh.

JR Sharma, secretary, Bar Council of India (BCI), issued a notification on March 8, giving a call to lawyers across the nation to abstain from work on March 11 to protest the brutal assault on lawyers in Jaipur and Chandigarh. The lawyers all across the country (except in Delhi who observed abstention on March 7) have confirmed to participate.

The notification asked the protest to be peaceful and carried out in a dignified manner. The BCI is a statutory body constituted under the Advocates Act, 1961.

In Chandigarh, lawyers of the Punjab & Haryana high court were lathi-charged and bombarded with water cannons outside the state assembly while protesting against the registration of a complaint against 20 advocates. However, the chief justice of the Punjab & Haryana high court, exercising suo moto powers, directed the FIR proceedings against the lawyers be stayed.

Meanwhile, a couple of days ago, lawyers in Jaipur had gathered outside the high court and marched towards the state assembly demanding redressal of their grievances including demands for a ‘residential project at subsidised rates’. They allegedly broke through the barricades and manhandled the police.

Lawyer Harshad Nimbalkar, member of Maharashtra and Goa Bar Council said, “A meeting was held in Mumbai on March 7 to discuss this issue. Accordingly, the decision has been taken. This is a peaceful protest and we would only abstain from work. It is high time that a law is introduced to protect the lawyers.”

Pune Bar Association (PBA) president, Rajendra Umap, said, “The directions are from BCI and we have to follow it. We will be putting black ribbon on our arms. On Monday morning, we will give an application to principal district and sessions judge Anant Badar about our abstaining from court work. We have organised a rally inside the court premises.”

However, some advocates are not willing to participate in the protest. Advocate Shivraj Kadam said, “Though as lawyers we condemn the assault on advocates, we don’t believe that abstaining from work is the solution. It will in fact cause more inconvenience to all those in pursuit of justice.”

“The PBA has not given any intimidation to us. So, the court proceedings would continue as usual,” said a court official.
