Pune District Consumer Disputes Redressal Forum president VP Utpat and member SM Kumbhar have held Sony Ericsson Mobiles Communication and a Pune-based retailer responsible for deficiency in service acting on a complaint filed by a 21-year-old student.
The forum directed the company and retailer together to replace the mobile or pay the price of the mobile along with extended warranty amounting to Rs15,499, Rs5,000 as compensation for deficiency in service and Rs2,000 for suit charges.
The plaint was filed by engineering student Malvika Bansal, a resident of Pune on April 16, 2012 against Sony Ericsson Mobile Communications Pvt Ltd, Haryana and Infinity Retails Ltd.
Bansal’s plaint alleged, “I purchased a Sony Ericsson phone W910i for Rs14,949 on June 18, 2008 from the dealer and paid Rs550 for extended warranty. After some months there was display problem. I handed over the phone on July 10, 2009.”
However, the problem was not solved after it was returned. The respondents denied their liability.
The forum observed, “Bansal produced documents like tax invoice, legal notice and delivery challan. The dealer claimed he is not responsible and asked to be exonerated, but he is representing the manufacturing company. He has sold the mobile to Bansal. Documentary evidence shows that Bansal paid Rs15,499 and is entitled for replacement.”
