CBI rapped for slow pace of probe in Ishrat Jahan case

Application filed appealing for high court monitoring of the investigation.

Aggrieved by the slow pace of the probe by Central Bureau of Investigation (CBI) into the fake encounter of her daughter and three others in 2004, Ishrat Jahan’s mother Shamima Kausar on Friday filed an application seeking direct monitoring of the probe by Gujarat high court.

The investigation was handed over to CBI more than a year ago by an order of the high court. A bench of the Gujarat high court consisting of justices Jayant Patel and Abhilasha Kumari sought a detailed progress report from CBI on January 10 and posted the hearing for the next day.

“We have moved an application before the high court that we are not satisfied with the investigation conducted by CBI in the case,” said IH Syed, counsel for Kausar.

“Like the 2G spectrum corruption case, the Gujarat high court should monitor the investigation of the encounter case by seeking day to day progress of the ongoing probe,” he said. 

The court, on Friday, conducted hearing on the first status report submitted by the CBI in the case along with the agency’s demand for the services of IPS officer Satish Verma for six months. Meanwhile, justice Patel came down heavily on the central agency and said the status report filed by it was not satisfactory.

“There is no progress in the investigation even after one year of transfer to CBI. If you are not doing proper investigation then strictures will be passed and we will say that a senior officer shall remain present in the court,” said Justice Patel while hearing the case.

The judge was also of the view that the CBI was soft-pedalling the investigation. “This is not a satisfactory probe and even the dates of events are not mentioned in the report.”
CBI’s lawyer YN Ravani argued in court that, “CBI has to examine several witnesses in the case and it needs to take the probe outside the country also.”

Meanwhile, the state government protested any further extension of services of Verma to the CBI. Government Pleader PK Jani said the state needed Verma’s services and he had already spent ample time with CBI.

After hearing all parties, the court sought the actual date on which Verma started working for CBI as there was some confusion on this matter.
