Sohrabuddin case: Bombay HC reserves order on bail plea

The CBI opposed the bail plea on the grounds that they (accused) were part of a larger conspiracy.

The Bombay high court on Monday reserved its order on the bail application of two Gujarat police deputy superintendents, who were allegedly a part of the fake encounter of Sohrabuddin Shaikh in 2005 and the killing of his wife Kausarbi.

Justice Abhay Thipsay reserved the order on the bail pleas of Narendra Amin and ML Parmar. Appearing for Amin, senior counsel Ram Jethmalani had earlier argued that the only role attributed to Amin was that he was present at the cremation of Kausarbi along with other accused police officials.

Advocate Amit Nair had argued that Parmar has been in jail for more than five years. He had submitted that Parmar was neither a member of the encounter team, nor was he present while cremating Kausarbi. The CBI had opposed the bail plea on the grounds that they were part of a larger conspiracy and that their role was not limited.

Sohrabbudin and his wife were allegedly abducted by the Gujarat Anti Terrorism Squad (ATS) from Hyderabad and killed in a fake encounter near Gandhinagar in November 2005. A total of 16 accused are facing trial out of which eight are out on bail. Former Gujarat minister Amit Shah is also an accused in the case. The Supreme Court had recently transferred the case to Maharashtra from Gujarat.
