CBI weaves events to establish Tulsi Prajapati was murdered in cold-blood.
The Central Bureau of Investigation (CBI) has erected a new set of witness in the Tulsi Prajapati fake encounter case who can prove vital while nailing the accused cops.
The set of five witnesses are mainly siblings and family members of Tulsi Prajapati, Azam Khan in addition to Sohrabuddin’s brother Rubabuddin Sheikh.
The battery of police officers belonging to Rajasthan and few from Madhya Pradesh are also vital witnesses in the case. The police have taken their statements under section 164 of the Criminal Procedure Code (CrPC) before the magistrate which can be not retractable. During the probe by the CBI, more than two dozen witnesses have emerged in the case.
The four witnesses are Tulsi’s nephew Kundan Prajapati, his friend Vimal Srivas, Azam Khan’s mother and wife. Tulsi was afraid that he may be eliminated in the fake encounter by the Gujarat police.
He had communicated his fears through Rubabuddin to Kundan and Vimal, asking them to remain present with him whenever he was taken to Ahmedabad from Udaipur to attend court hearing of the Popular construction firing case, in which Azam Khan is also a co-accused.
When the duo came to protect Tulsi as he wanted and reached Udaipur with that intent, they were apprehended by local police and arrested under a narcotics case. Later on, they were also allegedly bashed up at Bhopalpura police station by then superintendent of police Dinesh MN and threatened to keep mum. Dinesh also informed them that Tulsi’s elimination was already decided.
However, Azam Khan was lucky enough as he informed his mother and wife well in time to accompany him to Ahmedabad. They always did that, as a result of which, Tulsi’s elimination could be thwarted on two occasions. The booking clerk of Sangita Travels, a bus of which Tulsi, Sohrabuddin and Kausarbi were traveling in, is also a vital eyewitness.
The CBI has added all four siblings as witnesses in the case. More than 10 police officers belonging to Rajasthan are witnesses to the case. According to legal sources, the statement under 164 is considered as crucial and as the investigating agency takes this statement in presence of judicial magistrate and cannot be retracted during the trial of the case, as such action is deemed punishable under the law.
In its charge sheet the CBI has claimed that the escort party of Udaipur jail had informed Tulsi about the order issued to eliminate him on their way to Ahmedabad from Udaipur.
With this, the CBI has tried to connect whole chain of witnesses who can easily establish that Tulsi knew about his imminent death and was subsequently eliminated in a fake encounter, as he feared.
