SIT opposes Zakia’s plea for SIT member Malhotra’s reports

The Supreme Court-appointed Special Investigation Team (SIT) has opposed Zakia Jafri and her ally, Teesta Setalvad’s plea for a copy of the reports prepared by SIT member AK Malhotra and submitted before the apex court in sealed cover.

Zakia and Teesta's lawyer, Mihir Desai, on Tuesday, argued before the metropolitan court that Malhotra had filed before the Apex Court some reports related to the communal riots of 2002 after making inquiries.

However, the SIT had not given them copies of Malhotra’s reports with the 550-page final report and 22,000 documents given to them, the lawyer said.

Desai further submitted that they had come to know that there were many contradictions between Malhotra's reports and the SIT's final report which had given a clean chit to chief minister Narendra Modi and 61 others in the case. Without copies of Malhotra’s reports, it would be impossible to come to any conclusion about the evidences on which the SIT had given them a clean chit, Desai told the court.

He further argued that they would not able to file a protest petition with strong grounds for arraignment of the persons accused in the Zakia’s petition.

The Supreme Court had expressly ordered the SIT to submit all the related documents collected by it during its investigation into the charges levelled by Zakia Jafri in her petition, Desai said.

However, SIT’s lawyer RS Jamuar opposed Desai’s arguments and told the court that all the documents had been given to the complainant.

He further said that under criminal law, Teesta Setalvad had no locus standi to file a petition on behalf of Zakia. There had been some complaints against Teesta that she had been tutoring witnesses, Jamuar said.

When Jamuar sought more time to file a reply to the arguments tendered by Desai, metropolitan magistrate BJ Ganatra posted further hearing of the case on July 4.

On the orders of the Supreme Court, the SIT had investigated into Zakia’s petition in which she had accused chief minister Narendra Modi and 61 others of complicity in the communal riots of 2002.

The SIT had submitted its final report in the matter before the Apex Court which had then directed it to submit it with all documents before the metropolitan court and also give their copies to Zakia.
