Gujarat riots: ar of words marks fight over SIT report

Court hearing pleas for copies of SIT report witnesses exchange of heated arguments between agency’s counsel and other lawyers.

The proceedings over the final report submitted by the SIT   witnessed heated exchange of words between veteran counsels appearing before the metropolitan court on Monday. The verbal exchange started soon after SIT counsel RS Jamuar rose to tender arguments to oppose the submissions of the victims’ counsel who pleaded the court to give them a copy of the final report filed by the SIT.

Jamuar said, “There are 120 crore people and everybody will come and say, ‘I’m from this community and I’m affected’. So everyone should not be provided with copies of the report.” To this, Zakia Jafri’s lawyer SM Vora responded immediately and said, “We are objecting to the use of word community by the counsel.” The SIT counsel then came under fire by the victims’ and NGOs’ lawyers for the next 20 minutes. 

All lawyers — counsel for Teesta Setalvad’s NGO Citizens for Justice and Peace (CJP) IM Munshi , JSM advocate Samshad Pathan and Gulbarg Society victim Fakir Mohammad’s lawyer Iqbal Sheikh — also made verbal attack on Jamuar, an elderly and senior counsel.

They mainly objected when Jamuar said they have no locus standi to seek the final report. “Zakia Jafri is now nowhere in the case as she lost it before the high court and Supreme Court.” At one point of time, Jamuar told the counsels with folded hands: “Please listen to me and have patience, please have pity on me.” The counsels were also irked when the SIT did not supply them with a copy of the application seeking one month time to submit the sets of voluminous documents related to the 550-page final report.

“Why the SIT did not supply the copy? They may have played   mischief and their intentions are malicious. The court should stop hearing,” the lawyers opposed SIT submission in one voice.
During the verbal war, Munshi said: “There is some malicious approach of the SIT as they did not provide us with a copy and are also seeking time to file related documents.”

Munshi said, “Why will SIT take so much of time? You took four months to file report and now are not submitting whole documents along with the report. You are now changing colour.”
