Sohrabuddin case: Hearing on Abhay Chudasama’s bail plea deferred

The hearing was deferred after the CBI requested the court not to hear the bail petition till the outcome of the bail petition filed by Amit Shah in the SC.

The Gujarat high court on Thursday deferred the hearing of IPS officer Abhay Chudasama’s bail plea to February 22. Chudasama is an accused in the Sohrabuddin Sheikh fake encounter case and is currently in judicial custody.

The hearing was deferred after the CBI requested the court not to hear the bail petition till the outcome of the bail petition filed by Amit Shah in the Supreme Court.

Shah is also an accused in the fake encounter case and is currently out on bail. The CBI has moved the Apex Court for cancellation of the bail granted to Shah by the Gujarat high court.

The CBI’s counsel on Thursday submitted before the high court that of the different grounds given by Chudasama for bail, one is that he should be enlarged on bail as Shah, who is facing the same charges, had been granted bail by the high court.

However, as the agency has moved the Supreme Court for cancellation of Shah’s bail, the matter should be deferred till the apex court takes a decision on Shah’s bail, the CBI’s lawyer said.
