Prosecute Narendra Modi for ignoring key report: RB Sreekumar

The former DGP, says the 2002 riots could’ve been curbed if govt had acted on his remedial report.

Former DGP RB Sreekumar has sought the prosecution of chief minister Narendra Modi, the then Gujarat minister of state for home and officials of the state's home department for ignoring an important intelligence report that could have checked the communal riots of 2002.

In his ninth affidavit to be filed before the Nanavati commission, Sreekumar has claimed that he had filed a remedial report when posted as additional director general of police (ADGP) of the state intelligence bureau (SIB). However, the government did not take any action on it, Sreekumar has stated.

He has further stated in his affidavit that he had prepared a remedial report suggesting various measures to instil confidence in the minority community and ensure that the culprits were booked.

Sreekumar submitted the affidavit before the probe panel on Thursday. He has said that it was not known whether [then additional chief secretary (home)] Ashok Narayan had disclosed any information contained in his reports to the government, the commission or the Supreme Court-appointed SIT.

Nothing is known about his reporting these intelligence inputs to senior authorities of the state government, particularly the chief minister, the affidavit says.

"This critical information is quite relevant and pivotal to the terms of reference of the commission, especially the role of the chief minister, bureaucrats and police officials during the riots and the subsequent normalization of public order," the affidavit says.
Sreekumar has also furnished a transcript of his conversation with Narayan prior to his appearance before the commission.

Talking to DNA about the contents of the transcript, Sreekumar said that Narayan had said in his presence that he had discussed with senior police officials whatever reports he had received about the role of the police.

"When I discussed [with Narayan] my report about remedial measures, Narayan told me: 'Everything will boomerang on us. This will harm us'. I have also discussed the fact that police officers were not following the instructions of their senior officers but were acting under political pressure," Sreekumar said.

He further said that the government or the chief minister had taken no action despite the report urging remedial action to curb the riots and to ensure that justice was done.

"Therefore, the chief minister and others can be prosecuted under section 166 of the IPC for not acting as a public servant and thereby violating the law deliberately," he said.
