The main allegation in the charge sheet served on IPS officer Rahul Sharma appears to be that he did not submit with the case papers the phone data CDs he had prepared during probe into two riot cases of Ahmedabad. However, in his petition heard by the Gujarat high court recently, Sharma stated that he had sent the CDs through a messenger to PP Pandey, the then joint commissioner of crime branch, Ahmedabad. Pandey had received the CDs and had later acknowledged this verbally when he met Sharma at the Ahmedabad police commissioner's office.

Sharma was DCP (control room), Ahmedabad, when he acquired the phone call data of the riot period for the city from two cellphone service providers then operating in Gujarat. Sharma says in his petition that after he was transferred and posted as commandant, SRP Group XI, Vav (Surat), he called a messenger from the control room and gave him the CDs with the instruction that he [messenger] should personally give them to PP Pandey. The messenger went to the crime branch office in Dafnala and personally gave the CDs to Pandey. The messenger then came back and told Sharma that he had given the CDs to Pandey personally.

In the petition, Sharma states that, after that, he met PP Pandey at Ahmedabad police commissioner's office as he had not yet relinquished charge as DCP (control room). Pandey was coming down the main staircase of the police commissioner's office building while Sharma was entering his office of DCP (control room) when the two met.

On seeing him, Pandey expressed surprise that he had been transferred. Sharma further says in his petition that it was then that he asked Pandey whether he had received the CDs and Pandey answered that he had. At this, Sharma advised Pande to keep the CDs safely along with the case papers. Sharma relinquished charge as DCP (control room), Ahmedabad, on July 5, 2002.
