Was former home secy fit to approve charges in 26/11 case?: Special court

The special court hearing the 26/11 trial on Friday asked the prosecution if the then additional chief secretary (home) Chitkala Zutshi was the right person to “apply her mind and give sanction” in the case.

Zutshi, who was trapped in Hotel Taj for over seven hours, had told the court that she had applied her mind and had given sanction to the crime branch and the Anti-Terrorism Squad (ATS) to prosecute Kasab and two others under various acts, including the charge of waging war against the country.

“I want you to answer whether or not a person who has witnessed the incident herself can apply her mind to give sanction in the case? Was there no one else available for giving sanction?” asked first additional principal judge ML Tahaliyani, adding that she may be prejudiced.

Special public prosecutor Ujjwal Nikam promised to give the answers by Monday. Nikam said the intercepted conversations between the Pakistani handlers and the terrorists prove the charge of waging war. He said the data from a GPS gadget shows that the gunmen came from Pakistan.
