Use video-conferencing to decide cases, say prison authorities

The prison authorities have suggested that the pendency of cases and overcrowding of jails can be addressed with the use of video-conferencing facility in deciding cases that magistrates visiting courts housed inside prisons to hear and dispose off petty cases instead of issuing warrants and seeking the production of the accused.

These suggestions have been made by the prison department to the Bombay high court during the hearing of the pubic interest litigation filed by an accused in an arms haul case, claiming that he is not being produced in court for lack of escort police.

The affidavit filed by public prosecutor Pandurang Pol says that there has been an amendment in section 275 of the Criminal Procedure Code, allowing courts to use video conferencing facility to record evidence of the accused. It also says that the high court should provide video conferencing facility in all courts in the state, against the 27 where it is currently available.

The other suggestion is that magistrates should visit courts housed inside prisons. The affidavit states that out of 25 courts in prisons, from January 1 to April 30, 701 accused have been tried for petty offenses and out of that the magistrates have disposed off 165 cases. The courts have been sitting every working Saturdays.

The prison officials have also suggested to the trials courts to not issue productions warrants, or if issued, the trial courts should hear the cases on first on board basis and ensure that there is no adjournment. The courts are also requested to sit late for completion of evidence in larger  public interest.
