The sessions court today acquitted two persons accused of robbing and raping a 36 year old woman four years ago.
Additional sessions judge Malpani Pawar acquitted the two persons- Shakil Rehman and Fazlu Rehman- observing that the prosecution has failed to prove its case and that there were discrepancies in the victims statement.
According to the prosecution, the two accused had brought the victim, a mother of five children to Mumbai in October 2005 under the pretext of arranging medical treatment to her youngest son who was suffering from kidney stones.
On October 4, 2005 the two accused, the victim and her son reached Mumbai. According to the police, when they were going to a lodge in south Mumbai, one of the accused, Shakil snatched the victim's purse, which contained cash Rs 50,000 and escaped.
The second accused- Fazlu then took the victim and her son to a lodge where he raped her in the night. The next day, the lady lodged a complaint with the MRA police station.
The prosecution examined five witnesses in the case including the son who visited Mumbai.
"During cross examination, the son told the court that only one of the accused had accompanied them to Mumbai from their village. This showed that there were contradictions in the victim and her son's statement," defence lawyer Wahab Khan said.
