Siddharth vice-principal seeks FIR against IPS officer in exam matter

Former vice-principal of Siddharth Law College im Mumbai, Chitra Salunkhe, upon whose earlier petition the Bombay High Court had ordered CBI inquiry against seven senior IPS officers, has filed another petition seeking FIR against IPS officer KL Bishnoi and a former principal.

Salunkhe had alleged in the earlier petition that Bishnoi, a 1985 batch officer, cleared his final year LLB examination with the help of the then acting principal, IA Inamdar, without appearing for the practical examination.

She had first lodged complaints against the two, and seven IPS officers handled the inquiry at various points. Later she moved the High Court, alleging that these officers, including the current chief of Maharashtra Anti-Terrorism Squad Rakesh Maria, were shielding Bishnoi.

On February 27, HC ruled that prima facie there was substance in her allegations, and directed CBI to conduct an inquiry against the seven officers. But the CBI inquiry was stayed till April 12, after one of the officers, Sanjay Saxena, filed an application challenging the order.

Salunkhe's latest petition seeks direction to the police to register criminal case against Bishnoi and AK Inamdar.

She has also sought quashing of the report by the Principal Sessions Judge Swapna Joshi, who had been directed by the High Court in July 2010 to conduct an inquiry.

Joshi was to find out whether Bishnoi appeared for the practical exam, whether Inamdar conducted the exam, and whether it was permissible for the principal to conduct the exam when the assigned examiner (Salunkhe herself) was present.

"The Principal Judge has submitted the report without examining Bishnoi and Inamdar. Only my statement was recorded. Hence there has been a serious miscarriage of law. The report is erroneous and arbitrary," Salunkhe's petition claims.

The division bench of Justice VM Kanade and Justice PD Kode today adjourned the hearing till April 17.
