Shiv Sena seeks Bombay High Court permission for Dussehra rally

In order to continue its forty-one-year old tradition, the Shiv Sena has approached the Bombay High Court seeking permission to hold the Dussehra rally this year at Shivaji Park.

The petition filed by Anil Parab, MLC, seeking permission is likely to come up for hearing on Tuesday. Sena wants the permission to hold the rally on October 6.

The Shiv Sainiks have filed the petition after the police refused to grant them permission to hold the rally.

In 2010, the high court had granted them the permission to hold the rally with the condition that they would abide by the noise pollution (Regulation and Control) rules 2001, which prescribes noise level of 50 decibels.

However, they had failed to maintain to the decibel level in silence zone as a result of which, an FIR was lodged by the police against two office bearers of Sena.

On May 5, 2010, the high court had directed the Maharashtra government to initiate steps to declare Shivaji Park as silence zone when a PIL was filed by a NGO, Wecom Trust. The court had exempted three days in a year from the silence zone purview - Maharashtra Day, Republic Day and Ambedkar Jayanti.
